The Third China FTZ Justice Forum Was Held Successfully

April 28th, 2016, the Third China FTZ Justice Forum, organized by Shanghai University of Finance and Economics, Supreme People’s Court 4th Civil Tribunal and Shanghai Intermediate Court No. 1, was held at the Training Centre of People’s Congress of Shanghai.
 
The topic of this forum is “Commercial Environment and Judicial Security in FTZ”. Representatives from Supreme People’s Court, Shanghai High People’s Court, Shanghai Intermediate Court No. 1, Shanghai Intermediate Court No. 2, Shanghai Pudong New Area People’s Court, and courts in  China (Fujian) Pilot Free Trade Zone and China (Guangdong) Pilot Free Trade Zone; and experts from Shanghai Commercial Mediation Center (SCMC), Shanghai International Economic and the Trade Arbitration Commission (SHIAC), Shanghai University of International Business and Economics, Fudan University, East China University of Political Science and Law (ECUPL), Wuhan University and Shanghai University of Finance and Economics (SUFE), carried out the “Commercial Environment and Judicial Security in FTZ” themed discussion.
 
 
Cui Yadong, the President of Shanghai High People’s Court; Zhang Yongjian, Chief Judge of Supreme People’s Court 4th Civil Tribunal; Fan Liming, President of Shanghai University of Finance and Economics; Chen Libin, President of Shanghai Intermediate Court No. 1 and Yanxu, Deputy Director of Shanghai FTZ Management Committee, Deputy Secretary of Pudong New Area government’s Party organization attended and delivered opening speeches.
 
President Fan firstly affirmed the achievement made by Shanghai FTZ Innovation Centre and FTZ rule of law research group. This time SUFE Law School won in internal adjustment of first-level discipline’s doctor station. The progress of SUFE’s law subject owed to everyone’s supports. Hope Law School could continue work together in order to make greater achievements and hope friends from all circles could offer support to SUFE as of old.
 
 
Zhang Yongjian, Chief Judge of Supreme People’s Court 4th Civil Tribunal; Chen Yajuan, Vice-President of Shanghai High People’s Court; Chen Libin, President of Shanghai Intermediate Court No. 1; Zhangbin, Shanghai Pudong New Area People’s Court; and Professor Zheng Shaohua, Principal Assistant of SUFE gave keynote lectures respectively. Professor Zheng Shaohua, on the topic of “Judicial Considerations of Competitive Neutrality”, put forward that competitive neutrality is an important regime in FTZ. Not only does competitive neutrality accords with the new rules of international business from free trade to fair trade, but also meets the need of national management’s modernization. The promotion of competitive neutrality needs judicial paths like judicial interpretation, cases, public interest litigation and solution in individual cases including typical cases like anti-subsidy, anti-dumping, improper supervision, improper taxes and anti-discrimination etc.
 
 
Later, participants launched discussion themed “Trial and Application of Law in FTZ” and “Dispute Resolution in FTZ”. Professor Song Xiaoyan and Ge Weijun, from SUFE Law School gave their opinions towards FTZ’s financial supervision and trading registration system. Other participants also have discussions on mediation, arbitration and expert witness etc.
 
Shanghai University of Finance and Economics, co-organized Supreme People’s Court and Shanghai Intermediate Court No. 1, established FTZ Judicial Research Centre and Supreme People’s Court’s FTZ Judicial Research Base, which center on the important strategic deployment of FTZ. A series of cooperation was carried out and achieved great successes in the aspect of academic research, social influence and talent cultivation etc. This is the third time for China FTZ Justice Forum. The topics of the last two were “ China (Shanghai ) FTZ System Construction and Judicial Security” and “Expanding FTZ’s Circumference and its Judicial Security” respectively. Experts from all kind of areas made theoretical and practical exploration in the three consecutive forums and provide powerful intellective support to FTZ’s judicial security.
